The Tax Consultants' Professional Liability Insurance:

When claiming before foreign courts, the insurer replaces, limited to his liability, costs not exceeding the corresponding value class on the amount insured according to German law concerning court costs and the law on fees and charges, unless in individual cases with the insurer agreed otherwise.

The insurance coverage for tax consultants does not apply to liability claims

a) which are brought before foreign courts; this also applies in the case of a domestic enforcement judgement (§722 ZPO).

b) by the breach or non-compliance of foreign laws.

The risk exclusions as per in a) and b) do not apply to the foreign countries of Europe, Turkey and the states on the territory of the former Soviet Union including Lithuania, Latvia and Estonia. In these cases the liability of the insurer is limited to the amount of the minimum insurance as required by law.

c) Included is the statutory liability arising from the breach or non-compliance of the laws of States not previously mentioned under b) to the extent these occurred in the course of an engagement in tax matters relating to the laws of taxation of such a country, and the contract between the policyholder and his contracting body is solely based on German law. In these cases the liability of the insurer is limited to the amount of the minimum insurance as required by law.

d) The insurance coverage does not include liability claims based on services rendered through subsidiary companies, branch establishments or branch offices of any kind abroad, as far as such claims are not included by a special agreement.

The insurance coverage for financial auditors and chartered accountants does not apply to liability claims

a) which are brought before foreign courts; this also applies in the case of a domestic enforcement judgement (§722 ZPO).

Conflict of interests
The lawyer is not allowed to advocate conflicting interests (§ 43a, 4, BRAO). Before accepting a mandate, there will be always an examination by a special computer programme or by registry blocking notices if there exists a conflict of interests.

Extrajudicial dispute settlement
In the case of proprietary conflicts in a lawyer-client relationship up to a value of dispute of EUR 15,000.00, it is possible to appeal to the arbitration board of the Federal Chamber of Lawyers (Bundesrechtsanwaltskammer) in Berlin (§ 191 f BRAO):
