Professional liability insurance for tax consultants

VSW – Die Versicherungsgemeinschaft für Steuerberater und Wirtschaftsprüfer (VSW) is a joint venture between Allianz Versicherungs-AG (42%), AXA Versicherung AG (34%) and ERGO Versicherung AG (24%). Further details can be found at www.v-s-w.de.

Insurance protection is in place in accordance with standard professional requirements.

In the event of a claim before foreign courts, the insurer will reimburse, limited to its obligation to perform, costs at most in accordance with the value class of the sum insured under German cost and fee law, unless specifically otherwise agreed with the insurer.

Insurance protection for tax consultants does not cover liability claims

a) which are brought before foreign courts; this applies equally in the event of enforcement of a domestic judgement (§ 722 Code of Civil Procedure (ZPO));

b) arising from breach of or failure to respect foreign law. The risk exclusions under a) and b) do not, however, apply to other European countries, Turkey and former Soviet Union states, including Lithuania, Latvia and Estonia. The insurer’s obligation to perform is in these circumstances limited to the legally prescribed minimum amount insured.

c) Insurance covers the legal liability arising from breach of or failure to respect legislation in countries not specified under b) insofar as they have arisen in the course of the provision of commercial assistance in tax matters concerning the tax law of these states, and the contract between the policyholder and his client is governed exclusively by German law. The insurer’s obligation to perform is in these circumstances limited to the legally prescribed minimum amount insured.

d) The insurance protection does not cover liability claims brought in connection with activities which are carried out through branches, subsidiaries or other consultancies abroad, unless these are included by special agreement.

Conflict of interests
